Contract of Hire - Guests
La Marina Rentals & VillaKeyholders act as the Agent for the holiday home Owner. The Contract is between the Owner and the person making the booking (the Guest).
The property is to be occupied only by the persons and pet(s) specified on the booking form and for holiday purposes only. You and the members of your party also agree not to use the property for any illegal or commercial purpose, including subletting, this will result in the immediate termination of the contract and also for you and your party to leave the property with immediate effect.
Once the booking has been made the Guest is obliged to make full payment of the accommodation cost either as one single payment if the date of booking is within 6 weeks of the start of the stay, or as a deposit 15% and a balance 85% – see Payments below.
When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form. This does not form a contract between us or between you and the owner.
A contract with the owner shall only arise when your booking is subsequently confirmed in writing via a booking confirmation sent to you by email. By clicking the online "accept" button you agree to all of the Booking Conditions and Terms listed here without exception.
By completing and submitting the electronic booking form you are making an offer to purchase a rental at a holiday property which, if accepted by us, will result in a binding contract between you and the property owner.
The rental price includes, electricity, water, gas and the final cleaning. Air-conditioning is charged depending on the property. The prices are correct and valid at the time of booking.
The agents reserve the right to change prices according to costs. We will not however change the price of your accommodation or air-conditioning after booking and confirmation.
All payments must be made in euros. A deposit of not less than 15% of the total rental is payable at the time of booking. If the deposit is not received within 5 working days the reservation will expire and the guests are not longer entitled to the property. The balance is payable 6 weeks prior to the holiday date. Where the booking is made within 6 weeks of the holiday date, full payment is required with booking.
Payment can be made via PayPal, a charge of 3,9% is made for payments by PayPal. Payment may also be made by direct Bank Transfer provided that the payer covers all charges.
The agents reserve the right to re-let any holiday where any balances due are more then 14 days in arrears. If the agent is unable to re-let the property the guest will be remain liable for the outstanding balance of the rental.
Arrival & Departure
The Guest and his/her party may arrive not earlier than 16:00 on the arrival day and must depart not later than 10:00 on the departure day unless specifically advised otherwise.
Arrival after 20:00 and departure prior to 08:00 is subject to an additional fee of €36,00
Failure to adhere to these times can result in additional rental charges plus a fee for delayed or hindered access to the property by cleaners and keyholders.
The guests must telephone (0034) 628 72 43 03 when leaving either Alicante or Murcia airport, or at least 20 minutes prior to arrival at the property, so that the keyholder can meet the guests at the property.
Guests arriving between the hours of 20:00 and 08:00 will be charged an additional €36,00. Guests requiring departure prior to 08:00 will also be charged an additional €36,00.
Conditions of Occupancy
Only the persons named on the booking form are permitted to stay overnight at the property unless agreed in advance by the owner.
During your occupancy you agree to have full consideration for the residents of neighbouring properties and not to cause any distress by generating excessive noise or for any antisocial behaviour, the owner can refuse you or any member of the party entry or continued occupancy of the property if you, or they, are behaving illegally or antisocially or if any damage is likely to be caused.
These actions will be treated as cancellation by you and the owner will not be liable for any refund of rental paid, additional costs of not being able to stay at the property and under no obligation to find you alternative accommodation.
Care of the Property / Breakage & Damage
The Guest is responsible for leaving the property clean and tidy and for any loss, breakage or damage. Any breakage or damage, however minor, must be reported immediately by the Guest to the Keyholder or Agent, who will make the appropriate charge for repair or replacement. The Guest will be responsible for the cost of any extra cleaning that may be required, this includes cleaning of oven and ovenware, microwave ovens, cleaning of BBQ's, removal of rubbish not disposed off before departure.
Any beach towels used by the guests must be laundered and dried prior to leaving the property; otherwise additional cleaning charges will be applied.
Pets are accepted only where indicated and provided that they are not left unattended at any time, they are not allowed on the furniture, nor in the bedrooms and that any pet hairs in the property and fouling in the grounds are removed before departure. Any pet(s) in the party must be declared at the time of booking and the additional charge paid.
The Agent and the Owner reserve the right to charge a security deposit. Where a Security Deposit is required the Guest will be advised at the time of booking the amount and the method of payment.
Right of Entry
The Guest must allow the Owner, his representatives and/or the keyholder reasonable access to the property without notice to the Guest.
Neither the Agent nor the Owner shall be liable to the Guest or any member of his/her party for any loss or damage to person or property arising from the letting.
We recommend that you take out travel insurance against cancellations, lost of personal property, accidental damage to personal property. Neither the Agents or the owners insurance does not cover theft of personal property from individual properties.
We also recommend that you ensure that you have the appropriate health care cover to obtain emergency treatment in Spain if required.
Non Availability of Property / Facilities / Amenities
Should the property become unavailable due to circumstances beyond the Agent's control, the Agent will endeavor to provide suitable alternative accommodation or will refund all monies paid (or a proportion in the event of curtailment).
The Owner reserves the right to alter or withdraw without prior notice facilities and/or amenities which have been advertised, where reasonably necessary due to repairs, maintenance or any other circumstances beyond their control.
The Agent will charge an admin fee in respect of any alteration made to a booking. The amount of the fee will be confirmed according to the alteration made. The minimum fee will be €50.
If the Guest needs or wants to cancel a booking he/she must inform the Agency immediately, the Balance payment must (if not already paid) be paid by the due date already specified on the booking confirmation whilst the cancellation is administered.
The property will be re-advertised and re-let where possible, if this is successful, a refund to the value of the re-booking will be made less an admin fee of €50.
Where the circumstances of the cancellation do not meet the above criteria no refund will be payable, you must still notify the Agent as soon as possible if you do not intend to take your holiday.
The deposit paid is non refundable in any event.
Any complaint must be taken up immediately by the Guest with the Owner (or his/her Caretaker) who must be afforded the opportunity to address the issue raised. The Agent regrets that it cannot take up a complaint after the Guest has vacated the property. Neither the Owner nor the Agent will be liable for any additional costs incurred or claimed by a Guest should he/she decide to vacate the property prior to the booked departure date.
